AN ACCRA HIGH Court has not accepted the contempt case filed against the Hon. Member of Parliament (MP) for the people of North Tongu in the Volta Region, Samuel Okudzeto Ablkwa by a Ghanaian Rev. with multiple names and mothers.
According to the Court, the MP was not served with any contempt procedure as was suggested, and asked that proper things should be done, as the case was ajourned Sine Die.
At a hearing today, Tuesday, February 21, 2023, following the filing of charges of contempt against the MP by Kwabena Adu Gyamfi, aka Reverend Victor Kusi Boateng, Secretary to the Board of Trustees of the questionable President Akufo-Addo’s (National) Cathedral, the court noted that the records available before it do not suggest that Mr. Ablakwa, MP was served.
But the Lawyers for Reverend Victor Kusi Boateng aka Kwabena Adu Gyimfi who was absent, argued that they have served him (MP) but he refused to accept it, hence his reasons for rejecting the document were not tangible.
They further argued that the MP also disrespected the court when he shared copies of the court order on social media. But the court, in its ruling today, indicated that the respondent, Ablakwa, had not been served nor made any order to be served.
According to the judge, (Charles Gyamfi Danquah) documents procured by Ablakwa from social media cannot be accepted as a legal writ from the court.
“From ecords before this court, the respondent has not been served with any contempt procedure, and the court has also not made any order for such a process”.
“What learned counsel for the respondent procured either from social media or from learned counsel for the applicant cannot be taken as service of the contempt processes,” the sitting Judge opined.
To this effect, the court, therefore, ordered that the necessary legal steps be taken to serve the respondent on the contempt issue. Inview of this, the case was adjourned sine die for the respondent to be properly served.
